California Request for Entry of Default — Fair Debt Buying Practices Act is a law that was enacted in 2015 in order to protect consumers from unfair debt buying practices. The law requires debt buyers to provide a written notice to the debtor before requesting an entry of default. The notice must include information about the debt, the debt buyer’s right to collect on the debt, and the debtor’s right to dispute the debt. It also requires debt buyers to provide evidence to the court that the debt is valid before an entry of default can be entered. There are two types of California Request for Entry of Default — Fair Debt Buying Practices Act: 1) Request for Entry of Default — Fair Debt Collection Practices ActFDPCP) and 2) Request for Entry of Default — Fair Debt Buying Practices ActFDPBP). The FDP requires debt buyers to provide a written notice to the debtor before requesting an entry of default and the FDP requires debt buyers to provide evidence that the debt is valid.
