Utah Strict Liability is a legal concept that holds an individual or business responsible for damages caused by their products, regardless of fault. Under this doctrine, if a product is found to be defective and causes injury to an individual, the manufacturer or seller can be held liable, even if they have taken all reasonable precautions. The Utah Supreme Court has established that an “adequate warning” is an essential element of strict liability in order for a manufacturer or seller to be held liable. An adequate warning is a warning that is clear, conspicuous, and specific enough to alert a user to potential dangers posed by the product. There are three types of Utah Strict Liability: Design Defects, Manufacturing Defects, and Warning Defects. A Design Defect is a defect that exists in the product's design that renders the product unreasonably dangerous. A Manufacturing Defect is a defect in the product that occurs during the manufacturing process, which renders the product unreasonably dangerous. A Warning Defect is a defect that results from the manufacturer or seller failing to provide an “adequate warning” of potential danger associated with the product.
