Generally, statutory leave cannot be carried over to the next year unless your contract or workplace policy allows it. However, if you couldn't take leave due to long-term illness, the individual may carry up to 4 weeks of leave into the next holiday year.

Annual leave is pro-rated using this formula: (Number of completed months of service ÷ 12 months) × Number of days of annual leave entitlement.

Annual Leave for Sick Leave Purposes Employees may request annual leave instead of using sick leave (see Sick Leave (General Information) fact sheet). Although an employee may request annual leave for sick leave purposes, annual leave is subject to supervisory approval and may be denied.

Generally, those who want more vacation hours benefit from Annual Leave (AL). Those who have more reason for sick days (eg kids, illness, etc), benefit from Vacation/Sick (V/S).

You can legally take annual leave instead of sick leave though this has to be a request made by the employee not the employer. It can however be refused by the employer as long as they apply the refusal in a non-discriminatory way.

Your employer cannot insist you take annual leave on days you are off sick and have a medical certificate. You can continue to build up your annual leave entitlement while you are off sick, once you have a medical certificate.

This job protection is intended to reduce the stress that you may otherwise feel if forced to choose between work and family during a serious medical situation. Time off under the FMLA may not be held against you in employment actions such as hiring, promotions or discipline.
