This information describes ways that parents may change the name of their child under 18 years old. Enclosed is the Application for Change of Name (Child), and Order for Change of Name, which may help you do the job yourself.

When looking to change a child's last name, a parent must go through the Circuit Court of the county or city in which the child resides. A parent or guardian of the child can apply for the name change by submitting an Application for Change of Name of Minor to the Circuit Court.

The parents or legal guardians of the child must file a Petition for Change of Name with the court. The court must then sign an order granting the new name.

Marriage or Divorce Sometimes, when parents divorce, if one parent is awarded the majority of custody, they may choose to change the child's last name.This could be the last name of one of the parents, a hyphenated last name, or even a name that represents the combining of the two last names.

If you have sole parental responsibility, you will be able to change your child's name without anyone else's consent or a Court approval. You will still need to seek legal advice from a solicitor to make a formal deed to change their name.

Visit your local DMV and bring proof of your name change, proof of your identity, proof of address (2 documents), and proof of your Social Security number. The clerk will ask for the appropriate fee, which is currently $7.50.

If one parent is out of the picture, you don't need consent to change your child's last name. You do need to serve him or her with a conformed copy of the Order to Show Cause form. The other parent still does not have to consent or agree, just get served. Once served, a Proof of Service form must be filed.
