Utah Presumed Damages is a legal concept that provides compensation for injuries or damages that are presumed to exist even when they cannot be proven by the injured party. It applies to personal injury cases and is often used to help those who have been injured as a result of someone else’s negligence. There are two different types of Utah Presumed Damages: Non-Economic Damages and Economic Damages. Non-Economic Damages are damages for pain and suffering, emotional distress, disfigurement, disability, loss of enjoyment of life, and similar types of harm that cannot be easily quantified in monetary terms. Economic Damages are damages for lost wages, medical expenses, and other monetary losses that can be proven with documents such as medical bills or pay stubs.
