Affidavit of Service

A New Jersey Affidavit of Service is a legal document used in the state of New Jersey to prove that a document was served to a party. It is signed by the individual who delivered the documents to the party and is then notarized by a notary public. There are two types of New Jersey Affidavit of Service: Substitute Service and Personal Service. Substitute Service is when a document is delivered to an adult member of a household other than the recipient. Personal Service is when the document is delivered directly to the recipient. Both types of service require the Affidavit of Service to be signed by the individual delivering the documents and notarized by a notary public.

COMPLYING WITH AN INFORMATION SUBPOENA The subpoenaed witness must respond within 14 days of service of the information subpoenas. (N.J. Ct. R. -2.)

The proof shall be filed with the court promptly and in any event before action is to be taken on the matter by the court. Where service has been made by registered or certified mail, filing of the return receipt card with the court shall not be required.

A general appearance or an acceptance of the service of a summons, signed by the defendant's attorney or signed and acknowledged by the defendant (other than an infant or mentally incapacitated person), shall have the same effect as if the defendant had been properly served.

A proof of service made by affidavit or certification shall state the name and address of each attorney served, identifying the party that attorney represents, and the name and address of any pro se party.
