The party must present their appeal in writing, along with any relevant documents and evidence. There are three types of Hawaii Agency Appeals: administrative appeal, judicial review, and contested case. An administrative appeal is the process of appealing an agency decision to an administrative hearing officer. Judicial review is the process of appealing an agency decision to a court. Lastly, a contested case is the process of appealing an agency decision to a hearing officer appointed by the agency. In all of these cases, the burden of proof lies with the appellant.
