The Florida Affidavit In Proof of Claim And Non-Military Service — Count I (Tenant Eviction And Or Past Due Rents And Court Costs) is a legal document used in a landlord-tenant relationship when a tenant is being evicted or is behind on payment of rents and court costs. This document is used to swear to the court that the landlord has the right to evict the tenant for non-payment of rent and court costs. This affidavit can be used in two different types of eviction cases: one for past due rents and court costs, and one for tenant eviction and court costs. The Florida Affidavit In Proof of Claim And Non-Military Service — Count I (Tenant Eviction And Or Past Due Rents And Court Costs) must be completed by the landlord, and must include the name of the tenant, the amount of past due rent or court costs, and the date the rent or court costs were due. The affidavit must also include a statement affirming that the landlord has not received any military service orders that would prevent the tenant from paying the rent or court costs. The affidavit must be signed by the landlord in the presence of a notary public. Once the affidavit is completed, it must be filed with the court in order for the eviction process to continue.
