Illegal Entry by Deported Alien 8 U.S.C. Sec. 1326 is a federal law that criminalizes the re-entry of a deported alien into the United States without permission. There are two types of illegal entry by a deported alien 8 U.S.C. Sec. 1326: (1) aggravated re-entry and (2) simple re-entry. Aggravated re-entry applies to aliens who have been previously deported and have committed a felony or three or more misdemeanors in the United States before re-entering. Simple re-entry applies to aliens who have been previously deported and have not committed any felonies or more than two misdemeanors in the United States before re-entering. Both types of illegal entry by a deported alien 8 U.S.C. Sec. 1326 are punishable by fines and/or imprisonment.
