REENTRY OF DEPORTED ALIEN / 8 U.S.C. Sec. 1326(a) is a provision of the United States Code which states that it is a criminal offense to reenter the United States after being deported or removed from the country. This offense is a felony and carries a maximum sentence of two years in prison. There are two types of reentry of deported aliens under 8 U.S.C. Sec. 1326(a): (1) illegal reentry by an alien who has been previously deported or removed and (2) illegal reentry by an alien who has been denied admission, excluded, deported, or removed from the United States. Both offenses carry a maximum sentence of two years in prison upon conviction.
