FLORIDA There's a new law to help homeowners worried about potential tree damage better protect their property. The initial bill HB 1159, or Private Property Rights, was sponsored by State Rep. Mike La Rosa. It allows homeowners to prune, trim, or remove trees without permit or application from local governments.

There are a number of protected species of trees that cannot trimmed, altered or removed without a professional license. Three such such species are the three native species of Mangroves in Florida. Mangroves are found along coastal areas and can be found on many plots of waterfront property.

A new law in Florida bans local governments from regulating tree removal and re-planting on private property. The new legislation called, "Private Property Rights," allows property owners to remove, replant, prune, or trim a tree without approval from their local municipality.

A TPO is a written order which, in general, makes it a criminal offence to cut down, top, lop, uproot, wilfully damage or wilfully destroy a tree protected by that order, or to cause or permit such actions, without the authority's permission.

There is a permit fee of $25/acre for private property (residential) tree removals and $50/acre for commercial removals. It is illegal to remove trees on your property without a permit if it is not exempt.

Trees that top this list include sand live oak, live oak, sabal palm (as long as they are not overly pruned and weakened by the inappropriately named hurricane cut), southern magnolia, bald cypress, yaupon holly, winged elm and crape myrtle.
