Accord and satisfaction is an informal method of dispute resolution. An "accord and satisfaction" is merely an assertion that a dispute has been settled and that full performance under the settlement agreement has been made. It usually presupposes the existence of a prior contract and a legitimate dispute over the amount owed. Accord and satisfaction is generally governed by state law. For there to be a valid accord and satisfaction of a debt or claim, there must be: (i) a disputed claim; (ii) a tender of a check for less than the amount of the claim by the debtor, and (iii) an acceptance of the tender by the creditor.
