West Virginia Suggested Execution is a type of execution whereby a death row inmate may be executed without a jury or judge’s recommendation. This type of execution is unique to West Virginia and allows the governor to sign a death warrant for a death row inmate if he or she is deemed to be a danger to society. The governor must make such a determination based on the facts presented by the prosecutor or parole board. West Virginia Suggested Execution is sometimes referred to as the “Governor’s Power of Mercy”. There are two types of West VirginiSuggestedee Execution: those that are based on an inmate’s criminal history and those that are based on the discretion of the governor.
