Utah Affidavit and Summons is a legal document used to initiate a civil action in Utah courts. It is issued by the court at the request of the plaintiff (the person initiating the lawsuit) and serves as a notice to the defendant (the person being sued) that they have been sued and must appear in court to respond to the complaint. The affidavit and summons includes the name of the court, the case number, the name of the plaintiff and defendant, the nature of the claim, and the date and time of the defendant's appearance in court. There are two types of Utah Affidavit and Summons: Summons Only and Summons and Complaint. A Summons Only is typically used for an uncontested case, while a Summons and Complaint is used when the defendant has to respond to the allegations contained in the complaint. Both types of Affidavit and Summons must be served on the defendant in person or through a process server.
