There are two types of 9.23 Controlled Substance-Distribution in or Near School offenses: Possession with Intent to Deliver, and Delivery. Delivery is when a person actually transfers or attempts to transfer a controlled substance to another person. Both offenses are punishable by fines and jail time, and both offenses are felonies.
