Sec. 1546(A) Use, Possession of Immigration Document Procured by Fraud — Elements is a federal law in the United States that prohibits individuals from knowingly using, attempting to use, possessing, or obtaining an immigration document procured by fraud or false representation. This law applies to immigrants and non-immigrants alike, and is punishable by up to ten years in prison and a fine of up to $250,000. The elements of 8 U.S.C. Sec. 1546(A) are: 1. The individual knowingly used, attempted to use, possessed, or obtained an immigration document; 2. The immigration document was procured by fraud or false representation; 3. The individual knew that the document was procured by fraud or false representation; and 4. The individual intended to use the document for some purpose related to their immigration status. If an individual violates 8 U.S.C. Sec. 1546(A), they can be subjected to civil or criminal penalties including imprisonment for up to ten years and a fine of up to $250,000.
