5.06 AIDING AND ABETTING/ACTING THROUGH ANOTHER is a form of criminal liability in which a person is held accountable for the criminal actions of another person. It applies when a person helps, encourages, counsels, or assists another person in the commission of a criminal offense. This type of criminal liability can include both actual and constructive aiding and abetting. Actual aiding and abetting requires that the person have a direct involvement in the criminal act. Constructive aiding and abetting applies when a person participates in the crime by providing some form of assistance, such as providing financial or moral support. There are two main types of 5.06 AIDING AND ABETTING/ACTING THROUGH ANOTHER: direct and indirect aiding and abetting. Direct aiding and abetting involves the person actively participating in the commission of the crime. Indirect aiding and abetting involves the person providing assistance to another in the commission of a crime without actually participating in the criminal act.
