18 U.S.C. Sec. 2113(E) KIDNAPPING OR MURDER DURING A BANK ROBBERY is a federal law that criminalizes the act of committing a kidnapping or murder during the commission of a bank robbery. The law applies to any person who, in the course of committing a bank robbery or in immediate flight therefrom, kidnaps any person or commits a murder. The offense is punishable by a term of imprisonment of not more than 25 years, or death if the murder was committed in the course of the robbery or attempted robbery. There are two types of kidnapping or murder during a bank robbery: first-degree murder and second-degree murder. First-degree murder involves premeditated killing or an intentional killing that is planned out in advance; second-degree murder is an unintentional killing that is not premeditated.
