If a municipal corporation, other governmental agency, or other owner of a wharf or port facility desires to have another party operate the port facility, the municipal corporation, the governmental agency, or owner of the port facility may Lease or license the facility to another party. Whether the operation of a facility by someone other than the appropriate governmental agency or the owner should be drafted in the form of a Lease or a license must be carefully considered due to the different consequences that attach to the different relationships. For example, a license can generally be revoked at any time by the licensor, and the only remedy of the licensee would be an action for damages
