FAQ

Employees who are on LWOP for a period, or periods, totaling 80 hours (normal number of workhours in 1 pay period) during a leave year have their leave credits reduced by the amount of leave earned in 1 pay period.

LWOP can be used regardless of whether the employee has sick or annual leave remaining, but those who accumulate more than 80 hours will have their annual and sick leave balances reduced by the amount they would have earned during the pay period when the 80-hour mark was crossed.

LWOP, or leave without pay, may be used instead of paid leave for various purposes with supervisory approval. Extended periods of leave without pay may affect health and retirement benefits, future pay adjustments, and leave accrual, however.

Annual and sick leaveYou won't earn any annual or sick leave for a pay period in which you reach a total of 80 hours of LWOP. However, you will earn annual and sick leave during the following pay periods until you once more accumulate 80 hours of LWOP.

Leave without pay (LWOP) is an approved temporary absence from duty in a nonpay status re-quested by an employee. The term does not cover a suspension, furlough, an absence for which leave has not been approved, or nonpay status during hours or days for which an employee would be compensated on an overtime basis.

Generally, leave without pay is a discretionary matter agreed between an employer and employee. It is possible, therefore, to limit other employment activities of an employee during a period of leave without pay.

If one don't have any leave in credit and medically unfit then can avail on medical ground. If the employee is sick and has no leave in his credit, then he can avail leave without pay. It should be borne in mind that leave is not a matter of right and is granted subject to exigencies of service.

An employee absent on leave without pay does not accrue annual leave during that period of absence. As with annual leave, sick leave does not continue to accrue while an employee is on unpaid leave. Leave without pay does not break the continuity of service provisions.
