Texas Summons in an Adversary Proceeding is a court document used to notify a defendant that they are being sued and must appear in court on a certain date. It is also known as a Citation in Texas. The Texas Summons will include the name of the court, the parties involved, the time and date of the hearing, and the cause of action. There are two types of Texas Summons in an Adversary Proceeding: Original Summons and Issued Summons. The Original Summons is issued by the court clerk to the defendant, and the Issued Summons is sent to the defendant after the Original Summons has been served. The Texas Summons must be served on the defendant in order for the case to move forward.
