Texas Certificate of Service is a document used to certify that a party has been served with court documents in a civil lawsuit. It is signed by the process server or others authorized individual acting on behalf of the court, and is filed in court to prove that the documents were served upon the defendant. There are two types of Texas Certificate of Service: (1) Waiver of Service or (2) Notice of Service. The Waiver of Service is used when the defendant has agreed to waive being served with the court documents and has signed an acknowledgement of receipt of service. The Notice of Service is used when the defendant has been served with the court documents by a process server. The Texas Certificate of Service must contain the name of the court, the case number, the date of service, the manner in which the documents were served, the name of the person served, and the signature of the process server or other authorized individual.
