South Dakota New Ch 12 & 13 Single Debtor Plan Effective Dec 1, 2017 (WordPerfect) is a bankruptcy plan specifically designed for individuals who are unable to pay their debts. This plan allows individuals to reorganize their debts through a court-approved repayment plan. The plan is available in two different versions: Chapter 12 and Chapter 13. Chapter 12 is designed for debtors who are family farmers or fishermen, while Chapter 13 is designed for all other individuals. Both Chapter 12 and 13 are structured to allow debtors to make a single payment to a court-appointed trustee, who will then distribute the payment among the creditors. The repayment plan also allows debtors to keep some of their possessions, such as their home, car, and other personal property. Under the South Dakota New Ch 12 & 13 Single Debtor Plans, debtors must complete credit counseling, provide evidence of their income to the court, and submit a repayment plan. Once the repayment plan is approved, the debtor is then obligated to make payments on time for a period of three to five years. At the end of the repayment period, any remaining debt is discharged.
