New Hampshire Protective Order

Once a protective order is in effect against the abuser, it is a crime for the abuser to violate the order. If the abuser knowingly violates a protective order in any way, it is a class A misdemeanor crime. You should report any violations to the police. The police will decide whether to arrest and prosecute him/her.

Assault; reckless conduct; criminal threatening; sexual assault; criminal restraint or kidnapping you; false imprisonment. stalking; criminal mischief (destruction of property) or arson;

Criminal cases can end with a misdemeanor or felony conviction and can be punishable by prison time. A harassment charge is a legal charge filed against someone who intimidates, threatens, stalks, or otherwise makes another person feel unsafe or annoyed.

Tell the truth. The other person or his or her lawyer may also ask you questions. Give complete answers. If you do not understand, say I don't understand the question. If the other side lies in court, wait until he or she finishes talking. Speak only to the judge.

You can file a petition in the county/district where you live or where the abuser lives. If you have fled your home to avoid further abuse, you also have the option of filing the petition in the county/district where you are temporarily living.

N.H. Rev. Stat. § 644:4 Harassment. (e) With the purpose to annoy or alarm another, communicates any matter containing any threat to kidnap any person or to commit a violation of RSA 633:4; or a threat to the life or safety of another.

Be punctual. Make sure your witnesses are present and prepared. Ensure your evidence is ready. If witnesses or documents that have been subpoenaed and are not in the court, let the judge know. Dress in a manner similar to that as you would for a job interview.
