Nebraska Common to all protection types, Request for Hearing (provided with all Ex parte Orders) is the right of an individual to request a hearing to challenge a court order. The Nebraska Revised Statutes provide for this right to be included in all Ex parte Orders. Specifically, there are three types of Nebraska Common to all protection types, Request for Hearing (provided with all Ex parte Orders): 1) an Order of Protection to prevent harassment and/or domestic violence; 2) an Order of Protection to prevent stalking; and 3) an Order of Protection to prevent child abuse. In each case, the individual has the right to request a hearing to challenge the court order. The individual must submit a written Request for Hearing, which must be received by the court within five days of the date of issuance of the Ex parte Order. At the hearing, the individual can present evidence and make arguments to contest the order. The court will then decide whether to uphold, modify, or terminate the order.
