Michigan Order Vacating Conviction and Entering New Disposition is a procedure whereby a court vacates a conviction and enters a new disposition. This order is often used when a defendant has successfully completed probation, parole, or other alternative sentences, or when the conviction was overturned on appeal. There are two types of Michigan Order Vacating Conviction and Entering New Disposition: Vacated and Reversal and Remand. A Vacated order is issued when a court vacates a conviction and enters a new disposition without a hearing. The court will enter a “Not Guilty” verdict and the conviction will be erased from the defendant’s record. A Reversal and Remand order is issued when a court overturns a conviction on appeal and orders a new trial or hearing. The court will enter a “Not Guilty” verdict and the conviction will be erased from the defendant’s record.
