Illinois Paternity Order is a court order that establishes the parent-child relationship between a father and a child in the state of Illinois. The order is typically issued by the court after the Illinois Department of Healthcare and Family Services (HFS) has determined that the alleged father is the biological father of the child through the submission of genetic testing. There are two types of Illinois Paternity Order: voluntary and involuntary. A voluntary Paternity Order can be established when both parties voluntarily agree to enter into an agreement to establish paternity. An involuntary Paternity Order is issued when one party does not voluntarily agree to establish paternity and the other party files a petition with the court to establish the parent-child relationship. In either case, the order will include the legal rights and responsibilities that both parties have to the child, such as child support, visitation, decision-making, and health insurance.
