While judges typically handle matters of serious consequence (major criminal violations and civil matters involving grievous injury), they may delegate minor duties.

They are appointed by the chief judge to hear cases and make findings of fact and recommendations in a General Magistrate's Report to judges in the Family, Circuit Civil, Juvenile and Probate Divisions.

The basic requirements for filing a motion to dismiss in a criminal case include: Be in writing and signed by the party or party's attorney making the motion. State the grounds for the case. A copy of the motion must be served on the adverse party. Be sworn by the defendant. Be accompanied by a certificate of service.

A REFERRAL TO A GENERAL MAGISTRATE REQUIRES THE CONSENT OF ALL PARTIES. YOU ARE ENTITLED TO HAVE THIS MATTER HEARD BY A JUDGE.
