ACT NO. 22 OF 2002 [ 23rd May, 2002.] An Act further to amend the Code of Civil Procedure, 1908 and to provide for matters connected therewith or incidental thereto. (1) This Act may be called the Code of Civil Procedure (Amendment) Act, 2002 .
The 2015 amendments amended the following Federal Rules of Civil Procedure: Rule 1, Rule 4, Rule 16, Rule 26, Rule 30, Rule 31, Rule 33, Rule 34, Rule 37, Rule 55, and Rule 84 (this rule was abrogated).
Order VI Rule 7 ("O.VI R. 17") of the CPC defines the procedure for amendment of a pleading in a suit. It empowers the court to accept the application of a party to amend the pleading and simultaneously puts restrictions on the courts to use their discretion to the fullest.
Rule 28 - Amendment in pleadings : An application for amendment made under Order-I Rule 10, Order VI Rule 17 or Order XXII of the Code, shall also contain a prayer for all consequential amendments. The Presiding Officer shall reject the application if it is not in ance with the law or these rules.
Order VI Rule 17 of the CPC grants permission to the parties to the case to amend their pleadings at any stage of the proceedings. The proviso under this rule says that after the trial has commenced, an application for amendment shall not be allowed.
