Utah's “Clean Slate” law was implemented on February 10th 2022 and the Utah Courts began the process of automatically expunging qualifying misdemeanor records.
In March 2019, Utah lawmakers unanimously passed HB 431, Utah's Clean Slate law, which automatically clears qualifying misdemeanor records.
Class A Misdemeanor - 5 years. Class B Misdemeanor - 4 years. Class C Misdemeanors and Infraction Convictions - 3 years from closing date. Other Misdemeanor or Infraction - 3 years.
Record Expungement Eligibility Felonies under the Utah Controlled Substance Act: 10 years. Other felonies: 7 years. Class A misdemeanors: 5 years. Class B misdemeanors: 4 years.
Filing the Petition to Expunge Juvenile Records The petition to expunge the juvenile record must be filed in the juvenile court that handled the original juvenile court case. The original Criminal History Report from the Bureau of Criminal Identification (BCI) must be included with the petitioner.
