An Ohio Survivorship Deed is a document used to transfer real estate from one owner to two or more owners as joint tenants with right of survivorship. When one of the joint tenants dies, the surviving joint tenant automatically receives the deceased tenant’s share of the property. The two types of Ohio Survivorship Deeds are Statutory Forms and Non-Statutory Forms. Statutory Forms are those created by the Ohio legislature that are to be used as they are written. Non-Statutory Forms are those created by attorneys or individuals that may contain additional terms or language. Both types of Ohio Survivorship Deeds must be signed by all parties involved, notarized, and recorded with the county recorder’s office.
