Wisconsin Certification to Court of Appeals is a procedure by which the Wisconsin Supreme Court determines whether a case should be accepted for review by the Wisconsin Court of Appeals. It is a process which allows the Supreme Court to determine whether an appeal should be heard. There are two types of Wisconsin Certification to Court of Appeals: Direct Certification and Discretionary Certification. Direct Certification allows the Supreme Court to certify a case for review by the Court of Appeals without the need for an appeal from the lower court. Discretionary Certification requires the Supreme Court to determine whether review by the Court of Appeals is appropriate, and must be based on certain criteria. These criteria include whether the case involves a matter of great public importance, whether the case involves an issue of law for which there is no controlling Wisconsin precedent, and/or whether the case involves an issue of law that has been decided differently by different Wisconsin appellate courts.
