The Utah Notice of Lawsuit — Request for Waiver is a legal document issued by a plaintiff (the person filing the lawsuit) to a defendant (the person or entity being sued) that informs them of the lawsuit and requests that the defendant waive their right to be served with a summons. It is typically used in cases where the defendant’s whereabouts are unknown or cannot be located, and the plaintiff needs to proceed with the lawsuit without delay. There are two types of Utah Notice of Lawsuit — Request for Waiver: personal service waiver and mailed service waiver. With a personal service waiver, the plaintiff must serve the defendant with a copy of the notice of lawsuit and waiver request in person. With a mailed service waiver, the plaintiff must mail the notice of lawsuit and waiver request to the defendant’s last known address. The defendant must sign and return the waiver within 20 days of receipt, and if they do not, then the plaintiff may proceed with the lawsuit without their participation.
