Sec. 856(A)(1) MAINTAINING DRUG-INVOLVED PREMISES is a section of the Controlled Substances Act that prohibits individuals from knowingly or intentionally renting, leasing, or making available for use, any place, whether permanently or temporarily, for the purpose of manufacturing, distributing, or using any controlled substance. This section of the Act also establishes that it is illegal to maintain any premises for the purpose of unlawfully distributing, possessing with intent to distribute, or using any controlled substance, and that such premises shall be subject to forfeiture. There are two types of 21 U.S.C. Sec. 856(A)(1) MAINTAINING DRUG-INVOLVED PREMISES: knowingly and intentionally creating or maintaining a drug-involved premises, and recklessly creating or maintaining a drug-involved premises.
