Texas Issuance of Process Instructions for Writ of Execution is a form issued by the court to the Sheriff or Constable to enforce a judgment. This form instructs the Sheriff or Constable to seize and sell the defendant’s property to satisfy the debt owed. It is used when the court has ordered the defendant to pay a sum of money to the plaintiff and the defendant has not paid. The instructions for Writ of Execution are usually separated into two types in Texas — Writ of Execution on Personal Property and Writ of Execution on Real Property. The Writ of Execution on Personal Property gives the Sheriff or Constable instructions to take possession of and sell the debtor's personal property, such as vehicles, furniture, and household goods, and to apply the proceeds to the plaintiff's judgment. The Writ of Execution on Real Property gives the Sheriff or Constable instructions to seize and sell the debtor's real property, such as land, buildings, or homes, and to apply the proceeds to the plaintiff’s judgment.
