South Carolina Failure to File Return is a penalty imposed by the South Carolina Department of Revenue (SCOR) on taxpayers who fail to file their state tax return by the due date. This penalty applies to all types of South Carolina tax returns, including individual, corporate, and fiduciary income tax returns, as well as sales and use tax returns. Depending on the type of return, the penalty may be either 5% of the tax due or $10, whichever is greater, for each month or fraction of a month the return is late, up to a maximum of 25%. There are two types of South Carolina Failure to File Return: Late File Penalty and Failure to File Penalty. The Late File Penalty is imposed on returns that are filed past the due date but before the SCOR has begun an audit or assessment. The Failure to File Penalty is imposed on returns that are filed after the SCOR has begun an audit or assessment.
