The Oregon Claim of Violation of Crime Victims Rights — Criminal Case is a form of legal action that a crime victim can take if their rights have been violated. This claim is available to any crime victim in Oregon who believes that their rights have been violated under ORS 147.108 to 147.127 and ORS 147.837 to 147.851. These rights include, but are not limited to, the right to be present at all criminal proceedings, the right to be heard at certain proceedings, and the right to be informed of and participate in the criminal justice process. Victims can file a claim for a violation of their rights in criminal cases with the Oregon Department of Justice, which will then investigate the claim and determine whether to pursue it in court. There are two types of Oregon Claims of Violation of Crime Victims Rights — Criminal Case: a civil claim and a criminal claim. In a civil claim, the victim can seek monetary compensation for the violation of their rights, while in a criminal claim, the Oregon Department of Justice can file criminal charges against the offender for violating the victim's rights.
