Oregon Small Estate Affidavit is a legal form that allows the transfer of assets from an estate to the heirs of the deceased when the estate is valued at $275,000 or less. This form must be completed by the heir or heirs of the estate and notarized in order to be valid. It includes a declaration that the affine is an heir or successor of the deceased and that all debts of the estate, including taxes, have been paid and that no action has been taken to open a formal probate. There are two types of Oregon Small Estate Affidavit: the Small Estate Affidavit for Real Property and the Small Estate Affidavit for Personal Property. The former is used to transfer real estate, such as land, buildings, and homes, to the heirs of the deceased. The latter is used to transfer personal property, such as money, investments, and furniture, to the heirs of the deceased.
