The individual filing the Order to Show Cause and Verified Petition (H.P.) must explain why the court should issue the temporary restraining order or preliminary injunction to the other party. The Order to Show Cause and Verified Petition (H.P.) must be served on the other party to provide notice of the case. There are two different types of service in New York: personal service and service by mail, publication or posting. For personal service, the Order to Show Cause and Verified Petition (H.P.) must be personally delivered to the other party by a process server. The process server must have a copy of the Order to Show Cause and Verified Petition (H.P.) to deliver to the other party.
