New York Credit Counseling Requirement — Motion for Waiver (3/20/06) is a motion used to waive the requirement for credit counseling in New York. This motion is used by individuals who do not have the financial means to pay for credit counseling services, or who feel that the services are unnecessary for their case. This motion is applicable to those who are filing for bankruptcy in the state of New York on or after 3/20/06. The motion must be filed with the court and a hearing must be scheduled in order to make the request. There are three types of New York Credit Counseling Requirement — Motion for Waiver (3/20/06): 1) The "No-Asset" Motion; 2) The "Asset" Motion; and 3) The "Substantial Hardship" Motion. Each type of motion has specific requirements that must be met in order to be successful in obtaining a waiver.
