A New Mexico Writ of Garnishment is a court order issued by a court of law in the state of New Mexico which requires a third party, known as a garnishee, to turn over funds or assets to a plaintiff, known as the judgment creditor. This order usually applies to assets or funds that the garnishee holds for the debtor, known as the judgment debtor. There are two types of New Mexico Writ of Garnishment: (1) Wage Garnishment, which requires a garnishee to withhold a portion of the debtor's wages; and (2) Property Garnishment, which requires a garnishee to surrender any non-exempt property they hold for the debtor to the judgment creditor.
