A New Mexico Pretrial Order is a legal document issued by a court which outlines the procedures and protocols for the pretrial phase of a criminal case. It sets forth the expectations for both the prosecution and defense, including deadlines for discovery, motions, and filings, and establishes the parameters of the pretrial hearing. There are two types of New Mexico Pretrial Order: a Scheduling Order and a Case Management Order. The Scheduling Order specifies the dates for the filing of pretrial motions as well as the date of the pretrial hearing. The Case Management Order provides guidance on the procedures to be followed at the pretrial hearing. It may also include other provisions, such as the appointment of a defense attorney, that are necessary to ensure a fair trial.
