Michigan Notice of Appeal and Application (Drain Code — Apportionment Appeal) is a legal document used by landowners to appeal a decision of the drain commissioner regarding the apportionment of the cost of a drain project. This document must be filed with the county drain commissioner, who must hear and decide all appeals. There are two types of Michigan Notice of Appeal and Application: Apportionment Appeal and Drain Code Appeal. An Apportionment Appeal is used to challenge the apportionment of costs for a drain project as established by the drain commissioner. A Drain Code Appeal is used to challenge a decision of the drain commissioner regarding the construction, maintenance, or operation of a drain or drain system. In both instances, the Notice of Appeal and Application must include the name of the appellant, a description of the relief sought, and the facts upon which the appeal is based.
