This agreement is a sample of a Rototilling or Snow Plowing Agreement. Pursuant to this Agreement, Contractor agrees to indemnify Owner against any and all liability, demands, claims, losses, damages and expenses, for injuries to persons or property in connection with Contractor’s performance of its duties pursuant to this Agreement, but only to the extent that insurance proceeds are available. Owner releases Contractor, his employees, partners and successors from all claims and causes of action that Owner may later have, and which may arise by reason of injuries or damages sustained by reason of being struck by rocks, dust, debris, or other matter thrown from any snow plowing or rototilling on or adjacent to said Premises.
