A Florida Statement of Claim is a legal document used to start a lawsuit in the Florida court system. It provides the court with the necessary information to determine the parties involved, the purpose of the lawsuit, and the legal basis for the claim. The statement of claim must include all facts and legal arguments in support of the claim, as well as any evidence that may be necessary to prove the claim. There are three types of Florida Statement of Claim: Complaint, Counterclaim, and Cross-Claim. A Complaint is used to initiate a lawsuit, and is typically filed by the plaintiff. A Counterclaim is filed by the defendant in response to a Complaint, and alleges additional claims against the plaintiff. A Cross-Claim is filed by a defendant against a co-defendant and/or a third party.
