A Florida Certificate of Contested Matter (Out Of Time Motion) is a legal document issued by the Florida Supreme Court that allows a party to file an Out Of Time Motion in a case that has a pending motion, which was not timely filed. The Certificate is intended to protect the rights of parties who have missed filing deadlines, and may be granted if the Court finds that the party failed to file the motion due to excusable neglect or other good cause. There are two types of Florida Certificates of Contested Matter (Out Of Time Motion): (1) a Limited Certificate, which allows a party to file a single Out Of Time Motion; and (2) an Unlimited Certificate, which allows a party to file multiple Out Of Time Motions. The Court may impose certain conditions in the granting of the Certificate, such as requiring the party to pay a filing fee, serve the motion on other parties, or provide additional information to the Court.
