A California Affidavit — Death of Trustee is a legal document used to appoint a successor trustee in the event of the death of a trustee of a trust. This document is used to inform the court of the death of a trustee and to nominate a successor trustee to manage the trust in their place. There are two types of California Affidavit — Death of Trustee: A Revocable Living Trust Affidavit and an Irrevocable Trust Affidavit. The Revocable Living Trust Affidavit is used when the deceased trustee was the sole settler and trustee of a revocable living trust. The Irrevocable Trust Affidavit is used when the deceased trustee was the sole trustee of an irrevocable trust. Both documents must be signed by the successor trustee, the executor of the deceased trustee's estate, and two witnesses.
