Arizona Voluntary Paternity is a legal process by which a father voluntarily acknowledges his legal relationship to a child born out of wedlock. Establishing paternity is an important step in ensuring that a child has access to the rights and privileges that come with the legal father-child relationship. This includes the right to child support, access to medical records, and inheritance rights. There are two types of Arizona Voluntary Paternity: judicial and administrative. Judicial paternity is established when a father files a Petition to Establish Paternity with the court. The court will review the petition and then issue a judgment or order establishing paternity. Administrative paternity is established when a father and mother complete an affidavit of paternity at the hospital at the time of the child’s birth. The affidavit is then filed with the Arizona Department of Economic Security.
