What is this form?

The Name Affidavit of Seller is a legal document used to confirm a seller's legal name(s) and signature. Its primary purpose is to verify that different signatures belong to the same individual, ensuring clarity in real estate transactions. This form is crucial for distinguishing various "known as" names that a seller might have used, such as in the case of John Jones, John T. Jones, and J.T. Jones, all referring to the same person.

Form components explained

  • Legal signature declaration that must match signatures on closing documents.
  • Identification of any "known as" names in addition to the legal name.
  • Certification that the seller is the same individual named in all related documents.
  • Spaces for witnessing and notarization, reinforcing the affidavit's legal standing.

When to use this document

This form is typically used during the sale of real estate, particularly when the seller's identity is represented in various forms. It is essential when discrepancies exist in signatures across legal documents or when a seller has commonly used different names. This affidavit helps ensure that all transactions are legally binding and clearly attribute ownership to a single entity.
