Description

The parties may agree to a different performance. This is called an accord. When the accord is performed, this is called an accord and satisfaction. The original obligation is discharged. In order for there to be an accord and satisfaction, there must be a bona fide dispute; an agreement to settle the dispute; and the performance of the agreement. An example would be settlement of a lawsuit for breach of contract. The parties might settle for less than the amount called for under the contract.

FAQ

You can reapply for a new claim if you earned enough wages in the last 18 months and are still unemployed or working part time. Apply online, and we will notify you when your new claim is processed. This usually takes two to three weeks. For more information, refer to the unemployment insurance benefits calculator.

You must appeal in writing within 14 calendar days from the date that we mail you the Determination Notice. The date mailed is located on the top of the Determination on Payment of Unemployment Benefits form, and the last day you can file an appeal is at the bottom of the form.

Whether or not the claimant will be eligible depends upon the reason the claimant was suspended by the employer. If the claimant was suspended for wilfully and knowingly violating reasonable employer rules, the claimant will be disqualified on the basis of a discharge for misconduct connected with the work.

If you cannot work due to health reasons, personal responsibilities, or other limitations, your benefits may be disqualified. Additionally, if you refuse a suitable job offer without a valid reason, you could lose your unemployment benefits. You will also need to prove that you are actively searching for employment.

"An individual is disqualified for unemployment compensation benefits if the director finds that he or she left his or her most recent work voluntarily without good cause or that he or she has been discharged for misconduct connected with his or her most recent work."

You can appeal the decision by sending in the Appeal Form. Mail the appeal form within 30 days of the date the Notice was mailed to you. Mail the appeal form to the EDD address printed at the top of the Notice of Determination or Notice of Overpayment.

Why Would You be Denied Unemployment in California? You could be denied unemployment in California for several reasons, including being fired for misconduct, voluntarily quitting without good cause, or failing to meet the EDD's eligibility criteria.

If your claim is still active, wait two weeks and recheck the certification status in your Claim Summary for updates. You must continue to certify for benefits if your claim has a remaining balance and the benefit year end date has not passed. If the status doesn't change after two weeks, call 1-800-300-5616.

The claimant is allowed only one new claim per 52-week benefit year; once the new claim is filed, any subsequent opening of the claim is either an additional or a reopened claim, as described below.
